KAJIAN YURIDIS ATAS TINDAKAN DISKRIMINASI FIFA TERHADAP PENANGGUHAN RUSIA PADA PIALA DUNIA 2022 MENURUT DUHAM 1948

Abstract

The Although FIFA has established rules affirming its commitment to human rights, equality, and the principle of non-discrimination, controversy arose when the organization suspended Russia from all international competitions, including the 2022 FIFA World Cup , in response to Russias military invasion of Ukraine. This decision drew criticism for its perceived inconsistency, as FIFA continued to allow the participation of other countries involved in armed conflicts and human rights violations, such as Israel. The research problems in this study are as follows: (1) What is the form of FIFAs discrimination against Russia in the 2022 FIFA World Cup according to the 1948 Universal Declaration of Human Rights (UDHR)? (2) What is FIFAs legal standing as a non-state actor under international law? This study employs a normative juridical method using secondary data sources, data collection through literature study, and qualitative data analysis. The results show that (1) FIFAs actions against Russia violate the principle of non-discrimination as stipulated in Article 2 of the 1948 UDHR, Article 4 of the FIFA Statutes, and FIFAs own human rights policy, due to its inconsistent application toward all member states; (2) Although FIFA is not an intergovernmental organization, it holds a moral and normative position as a non-state actor that is obliged to respect international human rights principles, as reflected in its statutes, code of ethics, and human rights policy.
