PERLINDUNGAN HUKUM BAGI NASABAH DALAM TRANSAKSI GADAI TABUNGAN EMAS PADA PT PEGADAIAN (PERSERO) CABANG TARANDAM KOTA PADANG

Abstract

Legal protection for customers in gold savings pawn transactions at PT Pegadaian (Persero) Tarandam Unit, Padang City. The background of this research is based on the importance of protection for customers to avoid losses or misunderstandings in pawn transactions, especially gold savings products that have their own characteristics. The problems in this research are 1) What is the form of legal protection provided to consumers in gold savings pawn transactions at PT Pegadaian Perusahaan Tarandam, Padang City? 2) How are the efforts to resolve disputes between consumers and PT Pegadaian in gold savings pawn transactions? The method used is an empirical juridical approach with primary data through interviews with employees and consumers at PT Pegadain Tarandam, Padang City, as well as secondary data from official documents of PT Pegadaian, Padang City and related legal literature. The results of the study are 1) that in general PT Pegadaian provides legal protection to customers through the preparation of pawn contracts in accordance with legal provisions, the provision of information before transactions, and the development of digital systems. However, several problems still exist, such as inconsistencies in contract information, lack of customer understanding of auction risks, and technical constraints in the digital system. 2) To minimize disputes, Pegadaian has made various efforts, including officer training, improving the notification system, digital education for customers, and providing complaint services.
