IMPLEMENTASI GADAI TANAH PERTANIAN DI NAGARI TALU KECAMATAN TALAMAU KABUPATEN PASAMAN BARAT

Abstract

According to Article 7 of Law 56 Prp of 1960 concerning the Determination of Agricultural Land Area, anyone who owns agricultural land with a mortgage right which by the time this regulation comes into effect has lasted for 7 years or more must return the land to the landowner within one month after the planted crops have been harvested, and does not have the right to return to request a redemption payment number. Problem Formulation: 1) How is the implementation of agricultural land mortgages in Nagari Talu, Talamau District, West Pasaman Regency? 2) What are the obstacles to the implementation of agricultural land mortgages in Nagari Talu, Talamau District, West Pasaman Regency? 3) How to overcome the obstacles to the implementation of agricultural land mortgages in Nagari Talu, Talamau District, West Pasaman Regency? This form of study looks at social and legal aspects. The information comes from two sources: primary data and secondary data. To gather the data, researchers used interviews and examined documents. They analyzed the information using methods that focus on quality. The findings of the research show that 1) The way agricultural land pawning is done in the Nagari Talu community of Talamau District, West Pasaman Regency does not follow Law Number 56 Prp from 1960. 2) One problem with agricultural land pawning in Nagari Talu is that people in the community are not aware of the rules in Law Number 56 Prp from 1960. 3) Another issue with agricultural pawning is the need to educate people about Law Number 56 Prp from the National Land Agency.
