PERLINDUNGAN HUKUM BAGI PELAKU USAHA ONLINE PADA PLATFORM E-COMMERECE SHOPEE YANG MENGALAMI KERUGIAN CASH ONE DELIVERY (COD)

The development of e-commerce has facilitated transaction processes but, on the other hand, poses legal risks, particularly for business actors. On the Shopee platform, the Cash on Delivery (COD) payment system often results in losses due to unilateral cancellations by consumers without any obligation to provide compensation. This study addresses the following problems: (1) How is legal protection afforded to business actors on the Shopee e-commerce platform who incur losses through the COD payment method? (2) How is dispute resolution for online sales on the Shopee platform with the COD system conducted? This research employs a socio-legal method with a qualitative approach, using interviews with business actors, Shopee representatives, and the study of relevant documents and regulations. The findings show that: (1) The COD system does not guarantee payment certainty, does not protect business actors from unilateral cancellations, and does not provide compensation for shipping costs or damaged goods. (2) Dispute resolution is carried out through non-litigation mechanisms such as negotiation, Shopees Resolution Center, internal appeals, and institutions such as the Consumer Dispute Settlement Agency (BPSK). This study concludes that legal protection for business actors in COD transactions remains ineffective, and stricter regulations as well as a dispute resolution system that upholds contractual fairness are needed
