PERLINDUNGAN HUKUM TERHADAP DOKTER GIGI DALAM PENYELESAIAN SENGKETA MEDIS DI KOTA PEKANBARU

Based on Article 273 paragraph (1) letter a of Law No. 17 of 2023, medical personnel have the
right to legal protection, while Articles 310 paragraph (1) and 319 paragraph (1) regulate the
settlement of disputes outside the court through alternatives such as mediation. In Pekanbaru,
dental medical disputes, such as the cases of Mrs. D and Mrs. N, are generally resolved through
PDGI mediation using a restorative approach involving compensation, education, and the
implementation of informed consent. This study uses a socio-legal approach with primary data
obtained from interviews and secondary data from document studies, analyzed qualitatively.
The results show that restorative mediation protects dentists while fulfilling patients’ rights,
while the IDI-PDGI-Riau Police Memorandum of Understanding ensures professional
assessment before litigation, legal certainty, professional protection, and fair dispute resolution
