Abstract

The Indonesian National Armed Forces (TNI) is a key component in national defense, with the primary
function of safeguarding the sovereignty and territorial integrity of the Unitary State of the Republic of
Indonesia. With the enactment of Law Number 3 of 2025, there has been a fundamental shift in the TNI
paradigm. The TNI Law expands the number of civil institutions that active TNI soldiers may occupy,
from the previous 10 to 14 agencies. In fact, there is a legal loophole that allows active soldiers to occupy
strategic civil positions outside the ministry, which has caused controversy. Problem formulation: 1)
What are the legal regulations regarding the involvement of active TNI soldiers in civil positions
according to TNI Law Number 3 of 2025? 2) What is the impact of the expansion of civil positions for
active TNI soldiers before the enactment of TNI Law Number 3 of 2025? The data sources used are
primary and secondary data, then the data collection technique uses document studies which are then
analyzed using qualitative analysis. The results of the discussion: 1) Provides normative certainty, but
raises concerns regarding the neutrality of the TNI, military professionalism, and the principle of civil
supremacy in a democratic system. 2) The impact of the expansion of civil service positions for active
Indonesian National Armed Forces (TNI) personnel prior to the enactment of TNI Law Number 3 of 2025
is that it creates the risk of militarization of civil service positions, impacts civil supremacy and checks
and balances, disrupts TNI professionalism, and creates a closed legislative process and minimal public
transparency.
