PERANAN BADAN PENGAWAS PEMILU KOTA PADANG DALAM MENANGANI PELANGGARAN PEMILIHAN WALIKOTA DAN WAKIL WALIKOTA DI KOTA PADANG TAHUN 2018

Abstract

Election is the embodiment of peoples sovereignty in Indonesias democratic system.
To ensure the implementation of fair and honest elections, the Election Supervisory
Board (Bawaslu) holds a strategic role in its supervisory function. This research aims
to explain: (1) The role of Bawaslu Padang City in handling violations during the
2018 Mayor and Deputy Mayor Election; (2) The obstacles faced by Bawaslu
Padang City in the process of supervision and enforcement of violations; and (3) The
efforts made by Bawaslu Padang City to overcome these obstacles. This study is a
sociological legal research using primary data obtained through interviews with the
Coordinator of the Legal and Enforcement Division of Bawaslu Padang City, as well
as secondary data from legislation and related literature. The results of this research
are: (1) The role of Bawaslu Padang City in handling violations during the local
election includes: a. direct supervision of all stages of the election; b. prevention of
violations; c. handling of reports and findings of violations; d. enforcement and legal
recommendations. (2) The obstacles faced by Bawaslu in handling violations of the
Padang City local election include: a. limited human resources and technical
capacity; b. coordination problems among institutions; c. technical errors by election
organizers; d. low public participation and legal awareness. (3) The efforts made by
Bawaslu to address these obstacles and violations include: a. improving human
resources capacity; b. strengthening inter-agency collaboration; c. digitalizing the
supervision and reporting system; d. conducting community-based and local culture-
based socialization.
