PARTISIPASI MASYARAKAT DALAM PEMBENTUKAN PERATURAN DAERAH KOTA PADANG NOMOR 1 TAHUN 2025 TENTANG KETENTRAMAN DAN KETERTIBAN UMUM

Abstract

In the provisions of Article 96 of Law Number 13 of 2022 concerning the Formation of Legislation, it states that Public participation is a fundamental principle in the formation of legislation. Public participation is not just a formality in the meeting room but the right to be heard and considered. The formulation of the problem of this study: 1) What is the form of public participation in the formation of Padang City Regional Regulation Number 1 of 2025 concerning public order and tranquility? 2) What are the obstacles faced in the formation of Regional Regulations? 3) Efforts made to overcome the obstacles faced in the implementation of public participation in the formation of Regional Regulations? This study uses a sociological juridical research method. Data sources consist of primary data and secondary data, and data collection techniques by means of document studies and interviews and data analysis are carried out using qualitative analysis. The results of the study show that: 1) The form of public participation in the formation of Regional Regulations, stated that there was no participation, especially at the planning, drafting, and discussion stages. 2) Obstacles faced in the formation of Regional Regulations: a) Lack of public understanding in understanding Regional Regulations, b) Uncertainty of meeting schedules and limited invitation mechanisms. 3) Efforts made to overcome obstacles faced in implementing community participation in the formation of Regional Regulations: a) Providing socialization of understanding to the community regarding the contents of Regional Regulations, b) Scheduling meetings and invitations flexibly.
