Notaries are public officials who are authorized to make authentic deeds to ensure legal certainty, including in the making of fiduciary guarantee deeds that must be notarized and registered in order to have executory power. The formulation of the problem in this study is: (1) What are the responsibilities and authorities of notaries in the process of making fiduciary deeds; (2) What obstacles do notaries face in making a fiduciary deed; and (3) What efforts are made by notaries in overcoming these obstacles. The research method used is sociological juridical research with primary and secondary data sources, through interviews and document studies at the Notary Office of Rizky Rahmadani, S.H., M.Kn., Regency 50 Kota. The results of the study show that: (1) Notaries play a role in verifying the identity of the parties, drafting fiduciary guarantee deeds, registration through the AHU Online system, and abolishing fiduciary guarantees (roya); (2) The obstacles faced include data input errors, disruption of the AHU Online system, and the number of clients who do not have an NPWP; and (3) Efforts made by notaries include double checking data, utilizing registration system features, and using area codes as a substitute for NPWP. The discussion of the research shows that the accuracy and professionalism of the notary greatly determine the effectiveness of making a fiduciary guarantee deed as well as legal certainty and protection for the parties.
