PENGATURAN PERDAGANGAN INTERNASIONAL MENURUT GATT/WTO 1994 DAN IMPLEMENTASINYA DI INDONESIA

ABSTRACT

The global legal framework for international trade is regulated through the General Agreement on Tariffs and Trade (GATT) 1947, which later evolved into the World Trade Organization (WTO). However, in practice, the dynamics of international trade do not always run in accordance with agreed principles, as reflected in the trade war between the United States and China, marked by the unilateral imposition of import tariffs. The problem formulations are: 1) How is the regulation of international trade reviewed from the perspective of the 1994 GATT/WTO? 2) How is its implementation for Indonesia in the face of the global economy? This research uses a normative juridical approach. The data sources used are primary and secondary legal materials. The data collection technique in this study uses document studies, which are then analyzed qualitatively. The research results show that: 1) International trade regulations, as reviewed by the 1994 GATT/WTO, are based on articles on the Most-Favored Nation (MFN) Principle, the National Treatment Principle, the Transparency Principle, the Liberalization Principle, the Prohibition of Quantitative Restrictions Principle, the Multilateral Dispute Settlement Principle, and the Special and Differential Treatment (SDT) Principle. 2) Implementation for Indonesia with the Global Economy, namely, the national economy into the global market and increasing competitiveness, Implementation through Adjustment of National Regulations, Implementation of the MFN Principle in Trade Practices, Implementation of the National Treatment Principle for Imported Goods and Services, Implementation of Protection of National Interests through WTO Instruments, and Implementation in the Context of Increasing National Competitiveness.
