PELAKSANAAN PERAN NINIK MAMAK DALAM PERKAWINAN DI NAGARI KAMANG KECAMATAN KAMANG BARU KABUPATEN SIJUNJUNG

Marriage under Indonesian national law must not only be valid according to religion but also be officially registered to ensure legal certainty and legal protection. However, within the Minangkabau customary law community, particularly in Nagari Kamang, Kamang Baru District, Sijunjung Regency, marriage is not solely governed by state law but must also comply with customary law provisions through the involvement of ninik mamak as traditional leaders of the clan. In practice, there are still marriages conducted without following customary procedures and without the approval of ninik mamak, resulting in customary and social problems. The problems addressed in this study are: (1) What are the roles of the ninik mamak in the implementation of traditional marriage in Nagari Kamang? (2) What are the position and authority of ninik mamak in regulating and supervising customary marriage in Nagari Kamang? This research employs a sociological juridical method using primary and secondary data sources. Data were collected through interviews and document studies and analyzed qualitatively. The results of the study indicate that ninik mamak play an important role in granting customary approval, providing guidance, supervision, and resolving marital disputes. The position and authority of ninik mamak remain recognized under customary law and influence the marriage administrative process at the nagari level
