Abstract

Human trafficking is a serious transnational crime and a major violation of human rights. This crime often occurs through illegal recruitment of migrant workers with promises of high-paying jobs abroad that ultimately lead to exploitation. Indonesia, as one of the major labor-sending countries, faces numerous human trafficking cases, including the repatriation of 554 Indonesian citizens from Myanmar who were victims of exploitation by an international online scam network. The problems discussed in this research are how the prevention of human trafficking is regulated under the United Nations Convention against Transnational Organized Crime (UNTOC) and how the settlement of the repatriation case of 554 Indonesian citizens from Myanmar is addressed under Indonesian law. This study aims to analyze international legal regulations regarding human trafficking under UNTOC and examine the settlement efforts of the case within the framework of Indonesian national law. The research method used in this study is normative juridical legal research employing a statutory and conceptual approach. The data used are secondary data consisting of primary, secondary, and tertiary legal materials obtained through literature study and analyzed qualitatively. The results of the study show that UNTOC, through the Palermo Protocol, provides an international legal framework for the prevention, prosecution, and protection of victims of human trafficking by emphasizing the elements of act, means, and purpose of exploitation. In Indonesia, these provisions have been implemented through Law Number 21 of 2007 concerning the Eradication of the Crime of Human Trafficking. The settlement of the repatriation case of 554 Indonesian citizens from Myanmar was carried out through diplomatic cooperation between countries, evacuation of victims, and the provision of protection and rehabilitation for the victims after their return to Indonesia.
