Abstract

ABSTRACT

This study aims to analyze the registration of marriages due to religious differences in Indonesia from a legal perspective. The issue of registering interfaith marriages still raises debate and legal uncertainty due to the lack of clear regulations in legislation, particularly Law Number 1 of 1974 concerning Marriage as amended by Law Number 16 of 2019. The formulation of the problem in this study is: 1) how is the legal regulation regarding the registration of interfaith marriages in Indonesia; and 2) what is the procedure for registering interfaith marriages in the Indonesian legal system. The research method used is normative legal research with a statutory approach and a conceptual approach. The data sources used consist of primary legal materials and secondary legal materials collected through literature and document studies, then analyzed qualitatively. The results of the study indicate that: 1) the registration of interfaith marriages has not been clearly and comprehensively regulated in positive law; 2) the registration procedure still depends on court decisions, thus causing non-uniformity.
