ABSTRAK
The development of electronic commerce through the live streaming feature on the TikTok Shop platform raises legal issues related to the application of no-refund clauses that have the potential to harm consumers. This practice often conflicts with the principles of consumer protection stipulated in Law No. 8 of 1999 concerning Consumer Protection and the provisions of Government Regulation No. 80 of 2019. This study formulates three problems, namely: 1. What form of consumer protection is provided against the application of no-refund clauses in live streaming transactions on the TikTok Shop platform? 2. What is the legal impact of including non-refund clauses on the protection of consumer rights in live streaming transactions on TikTok Shop? 3. How effective is TikTok Shop's policy in providing fair protection for consumers against the application of non-refund clauses? The method used is sociological legal research with a descriptive analytical qualitative approach, through literature study and interviews with consumers and business actors. The results of the study show: 1. Normative legal protection is available, but its implementation is not yet optimal, 2. Non-refund clauses have the potential to be legally void because they reduce consumers' rights to compensation, 3. The platform's complaint mechanism is not yet fully effective in restoring consumer rights, so stronger supervision and transparency are needed.
