PROSEDUR PERUBAHAN HAK GUNA BANGUNAN MENJADI HAK MILIK DI KEMENTRIAN ANGRARIA TATA RUANG/BADAN PERTANAHAN NASIONAL KOTA DUMAI

Abstract

The Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) is a government institution authorized to regulate land services in Indonesia. ATR/BPN of Dumai City plays an important role in the process of changing the legal status of land rights, one of which is the conversion of Building Use Rights into Ownership Rights as a form of increasing legal certainty over community land. The research problems in this study are: 1) How is the procedure for converting Building Use Rights into Ownership Rights at ATR/BPN Dumai City? 2) What obstacles are faced by landowners holding HGB in the procedure of converting HGB into HM in Dumai City? 3) What efforts are made by ATR/BPN Dumai City and landowners holding HGB in carrying out this procedure? this research uses a sociological juridical approach with primary and secondary data sources, which are analyzed qualitatively. The results of the study indicate that: 1) The procedure for converting HGB into HM at ATR/BPN Dumai City is carried out in accordance with the provisions of the Basic Agrarian Law (UUPA) and Government Regulation Number 18 of 2021. 2) The obstacles faced by ATR/BPN Dumai City is community rejection of designated zoning areas. Meanwhile, the obstacles faced by the community include a lack of understanding of administrative 3) The efforts made by ATR/BPN Dumai City include administrative assistance to the community. Meanwhile, the community makes efforts utilizing electronic services to accelerate the process.
