PELAKSANAAN PERAN KANTOR URUSAN AGAMA (KUA) DALAM MENGATASI PERKAWINAN TIDAK TERCATAT DI KECAMATAN PATAMUAN KABUPATEN PADANG PARIAMAN

Unregistered marriage remains a legal and social issue that affects the protection of the rights of spouses and children, thereby requiring the active role of the Office of Religious Affairs (Kantor Urusan Agama/KUA) as the institution authorized to register marriages. This study identifies three main issues: (1) how the role of the KUA of Patamuan District is implemented in addressing the practice of unregistered marriages; (2) the obstacles faced by the KUA in addressing unregistered marriages in Tandikat Village, Patamuan District; and (3) the efforts undertaken by the KUA of Patamuan District to minimize or prevent unregistered marriages. The research method employed is a sociological juridical approach with qualitative data analysis, obtained through literature review and interviews with the Head of the KUA of Patamuan District and the Village Head. The results of the study indicate that: (1) the implementation of the KUA’s role is realized through preventive, substantive, and coordinative roles; (2) the obstacles faced include low public legal awareness regarding the importance of marriage registration, as well as economic, social, and educational factors; and (3) to address these issues, the KUA undertakes preventive efforts through education and counseling, substantive efforts through supervision and enforcement of orderly marriage administration, and coordinative efforts through strengthening cross-sectoral networks. Thus, the implementation of the KUA’s role demonstrates a commitment to providing legal protection for the community and sustainably reducing the practice of unregistered marriages.
