PERLINDUNGAN HUKUM TERHADAP ANAK PELAKU TINDAK PIDANA KEKERASAN SEKSUAL PADA ANAK DI KANTOR DINAS SOSIAL KOTA PADANG
Abstract
Law Number 11 of 2012 concerning the Juvenile Criminal Justice System emphasizes that children who commit crimes must receive legal protection that prioritizes the best interests of the child through a rehabilitative and restorative approach. In practice in the regions, the implementation of this protection requires further study, especially on the role of the Social Services in handling child perpetrators of sexual violence. The formulation of the problem in this study is: (1) how is the implementation of legal protection for child perpetrators of sexual violence against children at the Padang City Social Services Office? (2) What obstacles are faced by the Padang City Social Services in providing legal protection for child perpetrators of sexual violence against children? This study uses a sociological juridical research type with a socio-legal approach. Data sources consist of primary data through interviews and secondary data through document studies. Data
collection techniques are carried out through interviews and document studies, while data analysis uses qualitative methods. The results of the study show that: (1) Legal protection has been implemented through social assistance and rehabilitation for child perpetrators. (2) The obstacles faced include limited infrastructure, human resources, program continuity, and social factors
