PERLINDUNGAN HAK- HAK NARAPIDANA DALAM KONDISI KELEBIHAN KAPASITAS DI LEMBAGA PEMASYARAKATAN KELAS II B MUARO SIJUNJUNG
Abstract
The Class II B Correctional Institution of Muaro Sijunjung is a prison experiencing an overcapacity condition, with a total of 293 inmates compared to the ideal capacity of 150 inmates. As regulated in Article 4 paragraph (1) and paragraph (2) of the Regulation of the Minister of Law and Human Rights of the Republic of Indonesia, this condition has the potential to affect the implementation of the protection of prisoners' human rights. The formulation of the problems in this research are: 1) How is the implementation of the protection of prisoners' rights in the Class II B Correctional Institution of Muaro Sijunjung under conditions of overcapacity; 2) What are the obstacles encountered in the implementation of the protection of prisoners' rights under overcapacity conditions in the Class II B Correctional Institution of Muaro Sijunjung; 3) What efforts are made by officers to overcome the obstacles in implementing the protection of prisoners' rights in the Class II B Correctional Institution of
Muaro Sijunjung. This research uses a sociological juridical approach. The data sources used are primary and secondary data. Data collection techniques were conducted through document studies and interviews, and the data were analyzed qualitatively. The results of the study show that: 1) the protection of prisoners' rights continues to be implemented even though the prison is in an overcapacity condition. The rights to food and drink, health services, and freedom to practice religious worship have been fairly well fulfilled; however, the right to adequate housing has not been optimally fulfilled due to the overcrowded inmate occupancy. 2) The
obstacles faced include the emergence of discomfort, security issues, and disturbances to order. 3) The efforts made to overcome these obstacles include granting remission and involving assistance from the Indonesian National Armed Forces (TNI) and the Indonesian National Police (Polri).
