PERANAN SATUAN RESERSE KRIMINAL KEPOLISIAN RESOR PESISIR SELATAN DALAM MEMPROSES PELAKU TINDAK PIDANA PEMBAKARAN KAPAL PATROLI CEPAT
Abstract
Law enforcement is the authority of the Indonesian National Police as stipulated in Article 13 of
Law Number 2 of 2002 concerning the Indonesian National Police. The burning and destruction
of a fast patrol boat constitute the criminal offense of property damage as regulated in Article
406 of the Indonesian Criminal Code. One of the cases handled by the South Pesisir District
Police involves the destruction and burning of a fast patrol boat owned by the Ministry of
Marine Affairs and Fisheries. The research questions are: (1) What obstacles were encountered
by the Criminal Investigation Unit of the South Pesisir District Police in processing the
perpetrators of the fast patrol boat arson? (2) What efforts were undertaken by the Criminal
Investigation Unit of the South Pesisir District Police in enforcing the law against the
perpetrators of the fast patrol boat arson? This study employs an empirical juridical approach.
The data sources consist of primary and secondary data obtained through interviews and
document studies, which were then analyzed qualitatively. The findings indicate that (1) the main
obstacles were the absence of witnesses and dishonesty in providing testimony; (2) the efforts
undertaken included receiving and recording reports, conducting investigations and inquiries.
Although the case handling complied with applicable legal provisions, its implementation has
not been fully optimal.
