IMPLEMENTATION OF PROVISION OF LEGAL ASSISTANCE FREE OF CHARGE TO DEFENDANT IN COURT KLAS IA PADANG

Abstract

ABSTRAK

Law no. 16 of 2011 on Legal Aid is legal services provided by legal aid free of charge to the recipient of legal aid. Free legal aid is given to defendants who can not afford. The formulation of the problem is 1) How can the implementation of the provision of free legal aid to the accused in the Court of Class 1A Padang ? 2) what are the constraints encountered by the Padang Legal Aid Institute in the implementation of free legal aid. This type of research is a socio-juridical . Sources of data are primary data and secondary data. The technique of collecting data by interviews and document research. Analysis of qualitative data . Conclusions of the research 1) the implementation of the provision of free legal assistance to the defendant in the District Court of Class IA Champaign that judges appoint legal counsel for the defendant directly, after determination of the defendant was read, accompanied by legal counsel from the beginning of the trial until the case is

disconnected.2)The constraints encountered by Padang Legal Aid Institute of funding is still minimal budget funds given to the government's legal aid legal aid agencies to handle cases which were given free legal aid.
