Abstract

ABSTRAK

 

The right of every person, mandated in the basic laws 1945 section 27 subsection (1)” every citizen has the right to work and decent living for humanity”. Indonesian migrant workers (TKI) that working abroad is not supported by sufficient ability and low levels of education, in labor sending abroad more attention in terms of quantity and quality in terms of ignoring labor itself. In the formulation of the problem, 1) procedures and mechanisms for the protection of the law, 2) the obstacles faced in providing legal protection, 3) the efforts made to overcome the problems encountered. Methods of sociological research data obtained directly from the source first. Sociological studies that used the law, research on primary data or data base. Procedure sending workers must have a work visa, passports and identity cards to work abroad, every prospective workers should be given training in (BLK) before departure. Implementation of this program by the government for the protection in the pre-placement guided by Kepmenakertrans. 104A/MEN/2002. Constraints faced by many recruitment agencies who do the hiring are not in accordance with the procedures and the number of prospective workes who falsify their identity. For that efforts to resolve labor issues in general there are two settlement of labor issues through diplomatic channels and track agents / partners overseas recruitment agency.
