Pelaksanaan Pencekalan Terhadap Tersangka Tindak Pidana Korupsi Oleh Kantor Imigrasi Padang

Abstract

As the number corruptors who try to escape to the abroad for protecting themselves from the crime investigation process before being held or carried out, hence, it is required the role of immigration in order to avoid the corruptors go out from Indonesian territory. Formulation of the problems are: 1) how the implementation of the ban to the suspect of corruption by immigration office in Padang.  2) what problems were found in the implementation of the ban to the suspect of corruption by immigration office in Padang. The method that used in this thesis is a sociological judicial.  It is a legal research method that emphasize practical in the field and connecting it with the prevailing laws and regulations and focus on observation of the effectiveness from the law itself. The implementation of the ban that is done by immigration Padang in doing ban to the suspect of corruption is by waiting for the directorate general of immigration center request to avoid the suspect concerned in order not to leave the territory of Indonesia. That is to not allow him goes out of the territory of Indonesia when she/he requests the permission of it. The problems were found by immigration authorities to the suspect in the prevention of corruption are slow demand by concerned parties such as the police, judiciary, combating corruption commission to avoid that suspect and the renewal period of prevention that is dilatory to be extented. So that, that suspect can go out from the Indonesia territory.
