PELAKSANAAN PENYIDIKAN TERHADAP ANAK PELAKU PELANGGARAN LALU LINTAS YANG MENGAKIBATKAN KORBAN MENINGGAL DUNIA (Studi : Polresta Padang)
Abstract
Traffic violations which resulted in the victim's death, is set in Article 310 paragraph (4) of Law No. 22 of 2009 on Road Traffic and Road Transportation. This case is a lot going on in the city of Padang. In 2012-May 2014, there were 17 cases of traffic offenses committed by minors. One is the case of transport accidents involving a motorcycle in the city with Gunuang Sariak, Kuranji, Padang. Issues raised in this study were 1) How is the implementation of an investigation into child traffic violators who cause victims died in Padang Police Laka Then, 2) What obstacles encountered in investigations against child offenders of traffic violations that cause victims died in Laka Police then Padang. This study used socio-legal approach, and the sources of data in the form of primary data and secondary data. Data were obtained through interviews and document study. The data were analyzed qualitatively. From the study it can be concluded that: (1) The process of investigation on children as perpetrators of traffic violations that cause the death of the victim: public report is received by the clerk on duty, officers went to the scene, helping victims, secure the scene, secured suspect, by the scene, secure the goods evidence, crime scene sketches, and photographs the scene, and then conducted an investigation and filing. The constraints are found, namely: physical and psychological condition of children, witnesses, family, parent mentoring and Correctional Center (BAPAS).
