PENGATURAN ILLEGAL FISHING DI ZONA EKONOMI EKSLUSIF MENURUT KONVENSI HUKUM LAUT 1982 DAN IMPLEMENTASIDI INDONESIA
Abstract
Indonesia as maritime nations keep the potential of wealth resources oceanographer who have not explored and exploited optimally, and some even yet in know the potency which actually, so that the sea as alternative resources that can be taken into account in the future will be more developing world.Put indonesia has exerciss sovereign right ( soverign rights ) to do the utilization, conservation and management resources the fish of the exclusive economic zones of indonesia.Based on the background research that has been described above such problem is: ( 1 ) how is setting international law and national legal about illegal a fishing? ( 2 ) or how can the implementation of the arrangement of illegal a fishing occurring in exclusive economic zones indonesia?This research using legal approach normative.A source of data: secondary source of data consisting of a secondary law, primary, and tertier who analyzed in a qualitative manner. Based on the results of the research setting about Illegal Fishing, according to the law of the Sea Convention of 1982 that set in article 63 and 64 the 1982 UNCLOS, namely an agreement to implement in the form of the Agreement for the implementing of the UNCLOS on December 10, 1982 relating to the conservation and management of fish stoks strading (United Nations Implementing Agreement/UNIA). Signs that became the basis of the Setup in fisheries in the Exclusive economic zone of that Decision the Minister of Fisheries and Oceans number: Kep. 60/men/2001 about Foreign Fishing Vessels Use Setup in the Exclusive economic zone of Indonesia. Law enforcement is carried out in a comprehensive manner through the law enforcement investigators.
