Abstract

It batmarriageisanendorsement ofmarriagethathas beencarried outaccording toIslamiclaw,butnot recordedby theOffice of Religious AffairsortheRegistrarof MarriageOfficer.The problem isthat,1)Whatthe reasons fortheparties toconductthe marriagein the Religiousit batPadangClass1A,2)Howdoesthe judgein determining theconsideration ofmarriagein the ReligiousithbatPadangClass1A,3)What the constraintsfacedbytherelated totheimplementationof Marriagein the ReligiousIthbatPadangClass1A?Theresearch methodusedis asociologicalstudybasedonprimary data,the nature ofthe researchisdescriptive.Techniquesof data collectionisthroughinterviewsandanalysis ofthedatausingqualitative methods.The results showed1)That thereasons forthe parties to themarriagedoit batnamely:tome guruschild's birthcertificate,divorcetoCompletion,totake care ofretirement.2)Consideration ofthe judgein determiningtheit batmarriageifthe marriagecanbe provedinaccordancewith theshari'ahand thepillars of Islamanddoes notviolatethe law.3)Constraints faced bythe applicant, namelythe difficulty oftransportingwitnessesandthe cost oftransportation,whilethecourtis difficulttoprovewhether or not themarriagelegitimateapplicants.Kata Kunci: Itsbat Nikah, Pengadilan Agama
