THE APPLICATION ACTORS OF CRIMINAL EVASION CAR RENTAL IN PADANG (Case Study No. 368 / Pid . B / 2010 / PN . PDG )

Abstract

Criminal offense of embezzlement under Article 372 Code of Criminal Law. Many cases of
embezzlement of car rental in the city of Padang. This phenomenon is influenced by a number of
car rental business in the city of Padang. This criminal act must be very detrimental to the
victim. Usually the victims would sue for damages against the offender. Problems raised in this
thesis are: 1) How does the application against the perpetrators of criminal fraud in the District
Court of car rental Class IA Champaign? 2) How is the decision of compensation to the criminal
embezzlement rental car in State Court Class IA Champaign? This study uses normative
juridical approach. This study uses primary data and secondary data. Data collected by the
study of documents. From the study concluded: (1) The application of criminal sanctions against
the perpetrators of the crime of embezzlement of car rental in Class IA Padang District Court
applies Article 372 of the Criminal Code. In granting judges see the status of a criminal
defendant as a recidivist or not and judge consider the aggravating and ease during the trial. (2)
The decision does not change the loss dropped because the defendant behaved well during the
trial and the car as evidence still in installments or still owned by PT Oto Multiarta.
