PELAKSANAAN PENYIDIKAN TINDAK PIDANA KORUPSI DI KEJAKSAAN NEGERI SIMPANG EMPAT PASAMAN BARAT

Abstract

The authority of the Attorney as corruption investigator, the prosecutor's investigation is required to carry out the professional order completion corruption cases more optimal. Attorney authority to investigate corruption contained in Article 30 paragraph (1) letter d of Law No. 16 Th. 2004 on the Attorney RI and Article 27 of Law No. 20 Th 2001 on the amendment of Law No. 31 Th. 1999 on Corruption Eradication. The formulation of the problem is, 1) How is the implementation of the investigation of corruption in the State Attorney Simpang Empat West Pasaman ?. 2) What are the obstacles encountered in the investigation of corruption in the State Attorney Simpang Empat West Pasaman ?. This type of research is the socio-juridical. The data used include primary data and secondary data. Data were obtained through interviews and document study. The collected data were analyzed qualitatively. The results of this study concluded 1) the implementation of the investigation started from making reports of criminal acts, then make a warrant investigation and notification commencement of the investigation, until the transfer of the case file to the Public Prosecutor. 2) obstacles encountered was the lack of power and the investigating prosecutor in the case of examination of witnesses.
