PENGATURAN TENTANG PEMBERANTASAN PEREDARAN GELAP NARKOTIKA DAN PSIKOTROPIKA MENURUT UNITED NATIONS CONVENTION AGAINST ILLICT TRAFFIC IN NARCOTIC DRUGS AND PSYCHOTROPIC SUBSTANCES 1988 DAN IMPLEMENTASINYA DI INDONESIA
Abstract
Narcotics is a very complex issue in many countries starting from the 19th century to the 20th century, the legal arrangements for combating illicit trafficking in the international world started in 1909 since declared the Shanghai Conference, followed by the Convention of The Hague in 1912 continued under the League (League of Nationssuch as the 1925 Convention, the 1931 Convention Convention for Limiting the Manufacture and Regulating the Distribution of Narcotic Drugs, The 1936 Convention. Convention for the Suppression of the Illicit Traffic in Dangerous Drugs. followed by the United Nations (UN), which resulted in three conventions such as the 1953 Opium Protocol, the 1961 Single Convention, the 1972 Protocol amending the Single Convention, the 1971 Convention on Psychotropic Substances, The United Nations Convention Against Illicit Traffic in Narcotic Drugs and psychotropic substances, 1988, Indonesia had ratificated it with Act No. 22 of 1997 and was replaced by Law No. 35 of 2009 on narcotics which the application is expected to sanction and deterrent for criminals narcotics and psychotropic substances, This study aims to determine how the international and national arrangements in the fight against illicit trafficking, the extent of the application of the Convention on Combating Illicit Traffic in Narcotic Drugs and Psychotropic Substances, 1988 (Convention Against Illicit Traffic in Narcotics Drugs and Psychotropic Substances, 1988) in Indonesian national law. The method used in this paper is a normative juridical. The data from this study were obtained from the research literature which is then processed and analyzed qualitatively to obtain descriptive results.Keywords: Narcotic, Psychotropics, United Nations, Drugs
