Abstract

Indonesia is a country that consists of thousands of islands, and so we need a means of transportation to connect between the islands. In transport, the carrier shall organize transport safely and be responsible for the risk of adverse effects experienced by passengers and shippers. Based on this problem under study are: 1) How is the implementation of the agreement the transport of goods and / or passengers by sea at Pier Port Bungus Teluk Kabung Padang? 2) How is the responsibility of PT ASDP (Persero) in the transport of goods and / or passenger transport organizer angkutran as rivers, lakes and crossing the event of a default? 3) How is the implementation of the claim for damages on the PT ASDP (Persero). This study using sociological juridical approach, and data sources in the form of primary and secondary data. Data were obtained by interview and document study. Data were analyzed qualitatively. From the study it can be concluded that 1) the implementation of the transport agreement made when passengers or shippers buy tickets at the counter that has been provided and ends when the passenger or goods have arrived and unloaded at the dock destination. 2) The carrier is responsible for passengers and goods, began when the ship left the dock of departure to the destination dock. 3) filing a claim for damages in PT ASDP (Persero) is done by filling out an accident report form by attaching a ticket or mail transportation.
