ANALISIS HUKUM TERHADAP PUTUSAN HAKIM PADA PERKARA PERDATA NO.115/PDT.G/2013/PN. DI PENGADILAN NEGERI KLAS IA PADANG

Abstract

ABSTRAK  
This study aims to determine the process of filing and examination of civil cases No.115 / Pdt.G / 2013 / PN, the basic consideration in decisions and analyze the process of submission to the verdict, by comparing some data and regulations related to issues under meticulous Writer , as the basis acauan in answering questions that arise, as well as direct interviews with the parties involved in the case. The results obtained by the authors of this study, namely: (1) The process of filing a lawsuit represented by an attorney, the case has entered the stage of the examination of evidence and in principle claim is not accepted (Niet ontvankelijk verklaard). (2) The judges into consideration in its decision was that the lack of party and do not have a clear basis of the claim, the judge ruled that the lawsuit was not accepted. (3) Analysis of this decision is the fault of the plaintiff in formulating his complaint and also part of the negligence by the courts in implementing the mandate of Article 119 HIR / 143 Rbg., As well as the ineffectiveness of the mandate of Article 4 paragraph (2) Of the Law of Judicial Power.
