PELELANGAN KAYU SITAAN HASIL TINDAK PIDANA PEMBALAKAN LIAR (ILLEGAL LOGGING) (Studi Kasus di Kejaksaan Negeri Padang)

Abstract

 The auction is a sale of goods which is open to the public at a price quote in writing and / or oral increased or decreased to achieve the highest price. Auction Set implementation in Minister of Finance Regulation Number 106 / PMK.06 / 2013 About Changes in the Regulation of the Minister of Finance Number 93 / PMK.06 / 2010 Concerning the Implementation Guidelines for the Auction. Auction proceeds confiscated from illegal logging action by the prosecutor and the judge's ruling that the auction is done legally enforceable in court. Formulation of the problem (1) How does the auction timber from illegal logging criminal offense (illegal logging) by the State Attorney Padang? (2) Are the constraints faced by the prosecutor in the auction timber from illegal logging criminal offense (illegal logging)? This study using sociological juridical approach. Data used include primary data and secondary data. Data were collected through interviews and document study. Data were analyzed qualitatively. Of the research are: (1) Auction for timber logging proceeds of crime (illegal logging) by the State Attorney Padang carried out after obtaining a court decision which is legally binding and implemented globally or complete. (2) constraints Padang District Court in conducting the auction timber from illegal logging criminal offense (illegal logging), namely issuing of license auction by the Attorney General of the Republic of Indonesia, the determination of price limits and conditions of the damaged timber.
