PERANAN DPRD PROVINSI DALAM PENGUSULAN PEMBERHENTIAN GUBERNUR SEBAGAI KEPALA DAERAH MENURUT UNDANG-UNDANG REPUBLIK INDONESIA NOMOR 23 TAHUN 2014 TENTANG PEMERINTAHAN DAERAH

Abstract

DPRD has a working relationship that is equal in status and is partnering with the Governor. If the governor violated the oath of office and misconduct, the governor may be removed at the suggestion of the Provincial DPRD. Formulation of the problem: 1) How are the duties and authority of the Provincial DPRD the dismissal of the Governor as the head of the region according to Law No. 23 Year 2014 on Regional Government? 2) What is the mechanism of the dismissal of the governor as head of the region according to Law No. 23 Year 2014 on Regional Government? This type of research is normative research. Source of data used is secondary data. The collection of legal materials was done by using document study. Legal materials from the study documents analyzed qualitatively. Results of the study are: 1) the Provincial DPRD has the duty and authority that chose the governor in the event of a vacancy to continue the remainder of the term, proposing the appointment and dismissal to the President through the Minister for approval the appointment and dismissal as well as in the process of dismissal of DPRD is also giving consideration to the verdict Supreme Court. 2) The mechanism dismissal of the Governor is based on the decision of the Supreme Court on the opinion of the Provincial DPRD that the head of the region expressed violated the oath / pledge of office, not obligations, the opinion of the Provincial DPRD which will be the basis for the decision of the Supreme Court concerning the dismissal of the governor decided by the Plenary Session of the Provincial DPRD, the Court Supreme examine, and decide upon the opinion of the Provincial DPRD no later than 30 days, the President dismiss the governor no later than 30 days after receiving the proposal for dismissal of the leadership of the Provincial DPRD.
