PELAKSANAAN PEMERIKSAAN PERADILAN TINDAK PIDANA PENYIMPANGAN SEKSUAL DALAM HUBUNGAN KELUARGA (INCEST) (Studi di Pengadilan Negeri Klas IA Padang)
Abstract
The criminal act sexual despising to child is an action that fulfill criminal substance in cases that has contact by good manners and well behaved, whereas the age of victims under eighteen years old, incest is a force relationship that has sexual quality which done by a coup le that have close family bound (relative) usually between father and his daughter, mother and her son, or between the same wond relative or step brother the problem that investigating : 1) How does invesgation court implementation of criminal act for sexual deviation in family, 2) How does the applied of criminal law to the criminal actor in sexual deviation family, the approachness that done is sociological yuridic. The primary source data is interview in state court class IA Padang. The result of investigation can be concluded the process of court investigation criminal act for sexual deviation in family in the assembly is closed, the apply of sanction to the sucected is suitable whith 81 article cluse I ordinance number 23 in 2002 and the article 64 KUHP, next the judge decide a punishment for defendant by play whith the idea of case emphasize : The action of defendant cause shame to the victim and his family and the case that lightness the defendant admit and regret his action and polite behave in the court, even the never punished
