PENEGAKAN HUKUM PIDANA PENCEMARAN LINGKUNGAN DALAM PENGELOLAAN SAMPAH DI KABUPATEN PASAMAN BARAT

Abstract

Environmental pollutions regulated in Law No. 32 of 2009 on the Protection and Management of the Environment. Waste management is regulated in Law No.18 of 2008. The management of waste in the landfill Muara Kiawai not meets the standards of security and safety because it is not closed, so that waste management does not work effectively. Problems in this study; 1) How is the enforcement of the criminal law against environmental pollution in waste management in West Pasaman; 2) What factors are affecting the criminal enforcement of environmental pollution in waste management in West Pasaman; 3) What are the efforts made by the government in the West Pasaman waste management. This research used sociolegal approach.  The data used the primary and secondary data. Data was collected by documentary study,intrview,and observation. Data was analyzed qualitativevelly. Conclusions from the study indicate: 1) the criminal law enforcement of environmental pollution waste management dealt with punishment generic relatively heavy crimes or the crime of material, and a special criminal offense (specific crimes) on a relatively light administrative law. 2) Factors affecting the enforcement of criminal law is the absence of regulations governing waste management; 3) Efforts made in waste management is the method of disposal and landfill, and recycling methods, methods of avoidance and reduction.
