Abstract

ABSTRACT

Indonesian citizens who travel between countries must have a passport. The passport is a document issued by the Government of the Republic of Indonesia. paspor often misused  certain elements for profit by falsifying passports, causing losses to the state. Applying the law of passport forgery Against Perpetrators RI refers to Article 126 of Law No. 6 of 2011 on Immigration. Formulation of the problem: 1) How does law enforcement Against Perpetrators of the Crime of Forgery of passport of the Republic of Indonesia in particular Decision No 229 / Pid.B / 2013 /PN.TNG? 2) What is the fundamental basis of considerations judge sentenced Against Perpetrators of the Crime of Forgery of passport of the Republic of Indonesia in particular Decision No 229 / Pid.B / 2013 /PN.TNG? The research used is normative. The secondary data used include the primary legal materials, secondary, tertiary. Data collection technique using the document capital. Data were analyzed qualitatively. Based on the study findings: 1) The application of the law by judges against perpetrators of the cfrime of forgery of passport of the Republic of Indonesia in particular decision No 229 / Pid.B / 2013 /PN.TNG namely, shown to the defendant evidently did crime that stipulated in Article 126 A of Law No. 6 of 2011 on Immigration, judges convict defendants with criminal to prison for three months and a criminal fine of Rp. 10.000.000, -. 2) Consideration of the judge impose a criminal verdict against perpetrators of the Crime of forgery of passport especially Decision No 229 / Pid.B / 2013 /PN.TN in outline can be divided into 2,consideration of juridical and non-juridical considerations.
