PROSES PENYIDIKAN TERHADAP TINDAK PIDANA KEKERASAN PSIKIS DALAM KELUARGA YANG DILAKUKAN OLEH SUAMI TERHADAP ISTRI DI POLRES KOTA PADANG
Abstract
ABSTRACT
Domestic violence, especially psychological violence experienced by women. But in fact psychological violence is not much revealed in the process of investigation at the police level. Although Article 52 of Law No. 23 of 2004 on domestic violence victims psychological violence can assure a complaint to the police, and on the basis of complaints of police conduct the investigation. As for the formulation of the problem in this paper are (1) How is the process of investigation into the crime of psychological violence in the family who do husbands against wives in Padang Police? (2) Are the constraints faced by investigators in investigating criminal acts of psychological violence in the family who do husbands against wives in Padang Police? Penelitain juridical sociological method is by using primary data and secondary data as its data source. Data was collected through interviews and document study. The data obtained and analyzed using qualitative data analysis. Conclusion The results of the study are (1) the police may conduct an investigation based on the complaint of the victim, and based on standard operating procedures and the provisions of the legislation in force, the investigators received a report, examine witnesses, examine the suspect, arrest, detention, memintak information experts, and collect evidence. (2) Constraints faced by law enforcement police at Padang consists of internal obstacles that law enforcement agencies have not fully mastered the Domestic Violence Act and fasialitas provided BAL is still inadequate. And to external constraints that comply with the legal consciousness of Domestic Violence Act is still minimal.
