PERLINDUNGAN HUKUM TERHADAP ANAK SEBAGAI SAKSI KORBAN PADA TINGKAT PENYIDIKAN DI POLRESTA PADANG

Abstract

Child is the next generation of the nation which a forerunner of rising the new generation. The children can not protect themselves. From the thing that can causing mental haim, physical, social, so they needs protection. Guarantee of safety for children as witnesses be requlated in article 90 paragraph (1)  No. 11 in 2012 abaout law juvenile ccriminal justice system. The children as witnesses can be heard them opinion by recording electronics that conducted by the supervisor community which was attended yhe investigator, public prosecutor, and lawyer besides witness testimony can be obtained through the remote dianostcs by communication tools audiovisual with assistance parentr and supervisor community. Formulation of the problem: 1) how the form of legal protection of children as witnesses at the level of investigation in the Padang police? 2) whether the obstacles encountered in providing legal protection of children as witnesses at the level of investigation in the padang police? Types of research is juridical sociological data sourcewere primary and secondary data sourse. Data collection techniques were an interview and study the document. Data  were analyzed by  qualitatively. The conclusion research results that is: 1) a from of protection of children as witnesses at the level of investigation in the padang police can be done with the activities that are directly 2) the obstacles ecountered in providing legal protaction of children as witnesses at the level of investigation in the Padang police is difficulties in visiting the victim’s parents of witnesses trauma victims.
