PEMBAYARAN BIAYA PERKARA PERDATA DALAM PRAKTIKNYA DI PENGADILAN NEGERI KLAS I.A PADANG

Abstract

Court fees in Article 193 RBG / 182 HIR can be passed on to the loser, but the payment is paid in advance by the plaintiff at the time of registering the complaint. However, in practice the payment of court fees is often not working as it should. Problems studied authors are: 1) how the payment of the cost of a civil case in practice in Class IA Padang District Court; 2) efforts to do so if the verdict in the civil case fee payment can be accomplished; This research is a sociological and legal research is descriptive. Data collection techniques are interviews, the study documents and analyzes the results using qualitative methods. The results showed that; 1) The cost of the Registrar's Office and the costs of the process. Costs include the costs for the calling process will be biased 3x plaintiff panggilan.Biaya to call the defendant to be biased as much as 4x plus the cost of calls and secretariat. 2) Efforts to do so verdict that sentenced the defendant to pay the court fees is when the losing party does not want to implement the decision to pay the court fees voluntarily, then the court will carry out the execution, may seize and auction off goods prized possession losers whose results are used to pay the court fees.
