PELAKSANAAN MEDIASI OLEH MEDIATOR HAKIM DALAM PROSES PERKARA PERDATA DI PENGADILAN NEGERI KLAS I A PADANG

The mediation process is seen as a means of dispute resolution faster and cheaper compared to litigation. Enforcement of mediation is expected to expand access for all parties to gain a sense of justice. The mediation process in the judicial system to be able to strengthen and maximize the functions of the judiciary in the resolution of the dispute. The problem in this research are: 1. How does the mediation process undertaken judges as mediators in resolving civil cases in the District Court of Class IA Padang. 2. What are the factors that led to the success and failure of mediation in resolving civil proceedings in the District Court of Class IA Padang. This study uses socio-juridical, data sources consist of primary data and secondary data, engineering data collection consisted of interviews and document study, data analysis using qualitative analysis. From the results of the study concluded that: (1) The mediation process is done between the mediator and the parties consisting of 4 meetings. (2) The factors that cause success and failure of mediation is the quality of a mediator and the parties' willingness to resolve the dispute.
