PERLINDUNGAN ANAK MENURUT UNITED NATION CONVENTION AGAINTS TRANSNATIONAL ORGANIZED CRIME AND THE PROTOCOL THERETO (UNTOC) TERHADAP KEJAHATAN PERDAGANGAN ANAK DI INDONESIA

Abstract

Cooperation between countries either bilaterally or multilaterally, in the eradication of child trafficking is very needed openness from each country with fill in the blanks of the law in rules. Moreover, Indonesia will implement the AEC (ASEAN ECONOMIC COMMUNITY) in 2016. It needs to be re-thought and realise child protection arrangements in Indonesia that still have vacancies. The outline of issues raised are: 1) How child protection according to the United Nation Convention Againts the Transnational Organized Crime and the Protocol Thereto (UNTOC)? 2) how is the implementation of the United Nation Convention Againts the Transnational Organized Crime and the Protocol Thereto (UNTOC) in Indonesia?. The methods used in this study are normative. Normative legal research legal research is done by examining the references or secondary data. The results of this study are: 1) the Government of Indonesia has issued several regulations UN Traffcking Protocol rang the sense and the rules to be made by each State to ratify the UNTOC in eradicating the trade of people especially women and children. UNTOC have steps that are quite optimal in the eradication of the trade chain of people namely Prevention (article 9 prevention of UNTOC trade people), arrangements and cooperation. 2) DRUG involvement only to the giving of advice and strategic capacity building assistance (capacity building).
