PELAKSANAAN PENEBUSAN GADAI BATANG KELAPA ANTARA PENJUAL GADAI DENGAN PEMBELI GADAI DI NAGARI KOTO DALAM KABUPATEN PADANG PARIAMAN

Usually the object of pledge is ground, in Padang Pariaman which became the object of pledge is a palm trunk that should pawn it will end when redeemed. The issue: 1). How is the implementation of the redemption pledge palm trunk in Nagari Koto Dalam ?; 2). What problems were found in the implementation of the pawn redemption ?; 3). Are efforts to overcome the obstacles in the redemption pledge ?. To answer issues, the authors conducted a study with a juridical sociological research methods, sources of data in the form of primary data and secondary data, primary data obtained from the field research and secondary data obtained from the materials library. Analysis of the data obtained were analyzed qualitatively. The results of that study; 1) . implementation pawn redemption palm trunk in Nagari Koto Dalam is pawner who wants to make a pledge to contact the recipient pledge to make agreement on the amount of ransom, if an agreement is reached then the pawn sellers and buyers submit ransom submit a letter lien mortgage agreement, witnessed by leaders indigenous or Nagari officials, because of longstanding pledge so that redeem the pawn is an heir of the prior redemption of a pledge should be noted: the location of the object pledge, the number of coconut wood in the mortgage and still exist in the field; 2) . Obstacles found in pawn redemption palm trunk is no agreement between the two sides issue amount of ransom; 3) . Effort overcome the obstacles in the redemption of palm trunk in Nagari Koto Dalam can be resolved by consensus.
