PEMBAGIAN HARTA BERSAMA DALAM PERKARA PERCERAIAN DI PENGADILAN AGAMA PADANG KELAS 1A
Abstract
ABSTRACT
Divorce is a legal event that will bring a variety of legal consequences, one of which is the joint property in marriage. In writing this paper the authors propose several issues, namely: (1) How is the implementation of the division of joint property after the Court's decision Padang Religion Class 1A? (2) Does the efforts of judges, where one party does not carry out the judge's decision regarding the joint property of the Religious Court Padang Class 1A ?. While in this type of research used in this study is the sociological jurisdiction with data collection using interviews and document study. Analysis of the data used in this research is the analysis of qualitative data and drawn conclusions outlined in sentence form. It can be concluded that (1) the judge must first separate the joint property of treasures default then the treasure in the two and a half to his wife and half to the husband, (2) the efforts made when the joint property owned by one of the parties is with how report to the Chairman of the Religious order execution of the execution of the joint property.
