Abstract

Proof of cybercrime cases is largely determined by expert testimony. The definition of expert testimony is contained in Article 186 of the Criminal Procedure Code. One example of the use of expert testimony in cybercrime cases is Djoko Tjandra's red notice in the Bank Bali corruption case. Problem Formulation: 1) What is the judge's perception in assessing the testimony of digital forensic experts in cyber crime examinations? 2) What are the obstacles faced by judges in assessing the testimony of digital forensic experts in cyber crime examinations? This study uses a sociological legal approach. Sources of data used are primary data and secondary data. Data collection techniques through interviews and document studies. Data were analyzed qualitatively. The results of the study: 1) The judge's perception in assessing the testimony of digital forensic experts in cyber crime examinations, namely that the expert must have one of the specified qualifications, and the value of the strength of evidence attached to the expert's statement. 2) the obstacles faced by judges in assessing the information of digital forensic experts in examining cyber crimes are influenced by internal constraints and external constraints.
