KEBIJAKAN NON PENAL DALAM MENANGGULANG PENAMBANGAN BATUAN ILEGAL DI KABUPATEN PADANG PARIAMAN

Abstract
Based on Law No. 4 Year 2009 Article 1 paragraph (7) related to mining business permit,
problems that occur in Indonesia are many illegal mining that does not have permits, Mining
operations carried out without permission, operational procedures, thus making losses to the
country by exploiting Natural resources illegally, illegally distributing and selling illegal
mining activities. Problem formulation (1) Factors influencing the number of illegal logging
business practitioners in Padang Pariaman District The type of research is qualitative,
sociological juridical approach method. Based on the results of research can be concluded:
a) economic factors. The problem of poverty and no alternative source of income encourages
people to cut corners to meet economic needs by extracting illegal minerals 2) regulatory
factors and capacity of the apparatus. There is no set of rules and policies that are firm,
consistent, and transparent. 3) relationship pattern factor and licensed company policy.
