PERLINDUNGAN HUKUM ATAS HAK PELAYANAN KESEHATAN BAGI ORANG DENGAN GANGGUAN JIWA (ODGJ) TERLANTAR DI RS. JIWA PROF. HB. SAANIN PADANG

Abstract

Article 28 H Paragraph (1) of the 1945 Constitution and Article 4 Paragraph (1) of the Health Law states that everyone has the right to obtain health services. The 2018 Riskesdas data shows that ODGJ in West Sumatra Province is still high. Displaced ODGJ who are treated at HB. Saanin Mental Hospital Padang in 2023 as many as 35 people. Purpose of the study: to analyze legal protection, constraints, and efforts made on the right to health services for displaced ODGJ at HB. Saanin Mental Hospital Padang. The type of research was socio-legal. The data used were primary data and secondary data. Data collection was done through documentation, interviews and observation, data analyzed qualitatively. The results of the study: 1) Legal protection for displaced ODGJ was carried out by fulfilling regulations, human resources, and infrastructure 2) The obstacles faced were still weak cross-sectoral cooperation, no person in charge, and rejection of ODGJ by the community. 3) Efforts made were to increase cross-sectoral cooperation and provide health education to the community.
