EFEKTIVITAS PENEGAKAN HUKUM TERHADAP TINDAK PIDANA PENCURIAN HASIL PERERKEBUNAN KELAPA SAWIT DI KABUPATEN PASAMAN BARAT (STUDI KASUS POLRES PASAMAN BARAT)

Abstract

The prevention of theft carried out by the West Pasaman Police Resort is based on the Police Law and  Article 107 of the Plantation Law. Unauthorized harvesting is punishable by 4 years of imprisonment or a  fine of 4 billion rupiahs. Palm oil is one of the main commodities in West Pasaman. Palm oil theft in West  Pasaman Plantations from 2022 to 2024 tends to increase. The research problems are: (1) How effective is  the police in preventing palm oil theft in West Pasaman Regency? (2) What obstacles are faced by the  police in addressing the crime of palm oil theft? This study is a socio-legal research. To answer the  problems, primary data in the form of interview results and secondary data in the form of criminal statistics  were used. Data was obtained through semi-structured interviews and document studies. The collected data  was analyzed qualitatively. Base on the research results, it was concluded that: (1) The handling of palm  oil theft by the West Pasaman Police has not been optimal; (2) The obstacles faced by the police in  addressing palm oil theft are internal and external factors. Internal factors include limited human resources
and operational facilities and infrastructure. External factors are low public awareness and participation in  reporting, acting as witnesses, and a permissive culture regarding palm oil theft. In addition, there are  economic factors of the perpetrators as well as legal technical factors concerning evidence.
