KAJIAN YURIDIS PEMBUBARAN PARTAI POLITIK DI INDONESIA
Abstract
The development of political parties in Indonesia dates back to the Dutch government proclaimed ethical politics in 1908. Ahead of the 1955 elections to simplify the Indonesian party system, which regulates the recognition, supervision and dissolution of political parties. Dissolution of political parties is one of the authorities of the Constitutional Court. In writing this essay that the problem is 1.bagaimanakah by the dissolution of political parties in Indonesia, 2.bagaimanakah applicant's legal standing in the case of dissolution of political parties, and 3. What is the legal consequences if the political party disbanded. This type of research is a normative legal research library research and document study conducted in written documents. Dissolution of political parties in the Constitutional Court begins by submitting an application by the applicant and then recorded by the clerk in the registration books constitutional cases (BRPK). Then check the completeness of the materials of the Constitutional Court a petition in the preliminary hearing, the court then examined by a panel of judges consisting of at least 3 (three) constitutional judges. The results of examination by a panel of judges reported in the plenary meeting permusyawaratn judges to further consultation meetings with the judge's decision shall be confidential court. Regarding the applicant's legal standing in the case of dissolution of political parties if there acting as the applicant. Dissolution of political parties creates legal effect to the rights and responsibilities of internal and external stakeholders concerned. Political parties dissolved by reason of rules violation or contrary to the Constitution of the Republic of Indonesia Year 1945.
