TINJAUAN YURIDIS PERBUATAN MELAWAN HUKUM SENGKETA KEPEMILIKAN TANAH DALAM PERKARA NOMOR : 03/Pdt.G/2013/PN.TEBO DI PENGADILAN NEGERI KELAS II TEBO
Abstract
ABSTRAK
In case Number 03 / PD.G / 2013 / PN.TEBO in the District Court of Class II TEBO, Nurhayati Bin Taib (as Plaintiff) was adversely affected by the act Ridwan Bin Jafar (as Plaintiff) who had planted rubber trees and control of land owned by the Plaintiff , Defendant deed an act against the law set forth in Article 1365 of the Civil Code. The problems of this research are: 1) How does the application of Article 1365 of the Civil Code in case number: 03 / Pdt.G / 2013 / PN.Tebo in the District Court of Class II Tebo? 2) How is the consideration of judges in deciding the case number: 03 / Pdt.G / 2013 / PN.Tebo in the District Court of Class II Tebo? The method used is a normative legal research. Source data used are secondary data, ie data obtained by researchers of material legal literature, technical data penggumpulan study documents, analyzed by qualitative methods. The conclusions of this study: 1) the Defendant has been convicted of an unlawful act of annexation in the form of land owned by the Plaintiff (Traspass to land) under the provisions of Article 1365 of the Civil Code 2) Consideration of judges on the case Number 03 / Pdt.G / 2013 / PN.Tebo in Class II Tebo District court presumably it is right and appropriate legislation.
