PERANAN POLISI DALAM PENEGAKAN HUKUM KEPADA PENGENDARA SEPEDA MOTOR YANG TIDAK MEMENUHI PERSYARATAN TEKNIS DAN LAIK JALAN

Abstract

Act No.22 of 2009 about traffic and Road Transport set about traffic especially article 285 jo106 jo 48 of law No.22 of 2009 about the technical requirementsand be eligible toavehicle. Fenomenany a still found motorists who do not meet the technical requi rements and be eligible to the road as it does not use the rearview mirror, especially in Padang city. Formulation of the problem: (1) how is the role of theTrafficUnit(Satlantas) Polresta the field as law enforcement against motorists who do not meet the technical requirements and be eligible to the way? (2) whether the constraints faced by Satlantas Polresta Padang in law enforcement against motorists who do not meet the technical requirements and be eligible to theroad? This study used juridical socio legal approach. Data was used include primary data and secondary data. The technique of data collected through interviews and observation. The data were analyzed qualitatively. Results of the studyare: (1) a unit of traffic (Satlantas)Polresta Meadow have executed its roleas law enforcement against motorists who do not meet the technical requirementsand beeligible tostreet. (2) obstacles faced by SatlantasPolresta Desert polresta Desert Satlantas is the number oflimited, a limited number ofpatrol vehicles, lack of public awareness, the means and facilities, roads, family malfeasance.
