Abstract

ABSTRACT

United States military aggression to Iraq has two main reasons underlying these attacks, first, the United States wishes to stop the project development of weapons of mass destruction in Iraq, the second, droping the regime of Saddam Hussein. The UN Security Council did not approve of this agrgression because it does not quality to be a threat to world peace and security as contained in Chapter VII of the UN Charter, and not also in self-defense. By doing American military aggression to Iraq has violated international law. US aggression to Iraq not only destroys infrastructure, but more than that lifted the lives of thousands of civilians should be protected by humanitarian law. The method used in study is a normative law research that is by collecting materials from books, the internet, legislation and the results of scientific papers more closely related to the purpose of this scientific work. The purpose of this study is to describe the legality of US military aggression to Iraq under international law and how law enforcement for violations of war crimes committed by the US government and its military forces in Iraq according to international humanitarian law. US military aggression is a violation of international law because it did not have permission from the United Nations. The mechanism of enforcement of humanitarian law can be found in the 1949 Geneva Conventions and Additional Protocol 1 of 1977 and other rules governing enforcement against war crimes in a court of either ad-hoc or permanent.
